Terms of Use
EFFECTIVE 10 SEPTEMBER 2026
These Terms of Use ("Terms") govern access to and use of websites, applications, software, platforms, products, and services operated by Atlas Intelligence Ltd. ("Atlas", "we", "us", or "our"). By accessing or using an Atlas service, you agree to these Terms. If you use Atlas on behalf of an organization, you represent that you have authority to bind that organization to these Terms where applicable.
1. Atlas Services
Atlas develops technology for intelligence, analytics, data processing, prediction, simulation, and decision support. Atlas services may include:
- Software platforms
- Intelligence and analytics systems
- Data processing
- Predictive analytics
- Decision-support tools
- Digital twins
- Simulation
- Research and technical services
- Demonstrations
- Consulting
- Implementation and integration services
Specific services may be governed by additional agreements.
2. Eligibility and Authority
You may use Atlas services only where you have the legal capacity and authority required to do so. If you access Atlas on behalf of an organization, you must have authority to do so.
3. Accounts
Certain Atlas services may require an account. You are responsible for:
- Providing accurate account information
- Protecting authentication credentials
- Maintaining appropriate access controls
- Preventing unauthorized access
- Notifying Atlas of suspected unauthorized access
You are responsible for activity conducted through your account to the extent permitted by law.
4. Acceptable Use
You must use Atlas services lawfully and responsibly. You must not:
- Attempt to gain unauthorized access
- Circumvent security controls
- Interfere with Atlas systems
- Introduce malware or malicious code
- Abuse authentication credentials
- Attempt to compromise another user's account
- Reverse engineer services where prohibited by law
- Copy or extract protected platform components without authorization
- Use Atlas services for unlawful purposes
- Misrepresent Atlas outputs as guaranteed facts
- Attempt to access another organization's tenant or data
Atlas may restrict or suspend access where necessary to protect the platform, users, customers, or security of the service.
5. Customer Data
Customers may provide information to Atlas for processing through Atlas services. Except where a written agreement states otherwise, customers retain ownership of their data. Customers are responsible for ensuring that they have the necessary rights, permissions, notices, and lawful bases to provide data to Atlas for processing. Atlas processes customer data according to applicable agreements and authorized instructions.
6. Atlas Intellectual Property
Atlas and its licensors retain all rights, title, and interest in Atlas technology and intellectual property. This includes, where applicable:
- Software
- Source code
- Object code
- Algorithms
- Models
- Platform architecture
- Interfaces
- Databases developed by Atlas
- Documentation
- Designs
- Methodologies
- Processes
- Know-how
- Trademarks
- Logos
- Branding
These Terms do not transfer ownership of Atlas intellectual property to users or customers.
7. Feedback
If you provide suggestions, ideas, or feedback concerning Atlas services, Atlas may use that feedback to improve its products and services without creating an obligation to compensate you, unless otherwise agreed in writing.
8. Artificial Intelligence and Decision Support
Atlas services may use artificial intelligence, machine learning, statistical models, simulations, and other computational methods. Outputs may include predictions, recommendations, classifications, summaries, forecasts, or scenarios. Such outputs:
- May be incorrect
- May contain uncertainty
- Depend on available data
- Depend on model assumptions
- May change as data changes
- Should be reviewed within the relevant operational context
Atlas services are designed to support decision-making and do not eliminate the need for appropriate human judgment, professional expertise, or institutional accountability.
9. Data and Model Limitations
Atlas cannot guarantee that information supplied to or generated by a service will always be:
- Complete
- Accurate
- Current
- Error-free
- Available
- Suitable for every purpose
Users should evaluate outputs appropriately before relying upon them for consequential decisions.
10. Third-Party Services
Atlas may integrate with or depend on third-party services. Third-party services may be subject to their own terms, policies, availability, and security practices. Atlas is not responsible for third-party services outside Atlas's control.
11. Availability
Atlas seeks to maintain reliable services but does not guarantee uninterrupted or error-free availability. Services may be modified, suspended, maintained, or discontinued where reasonably necessary. Customer-specific availability commitments may be established through separate written agreements.
12. Security
Atlas implements reasonable security measures designed to protect its services and information. Users must also maintain appropriate security practices, including protecting credentials and using authorized access methods.
13. Confidentiality
Confidential information exchanged between Atlas and customers may be subject to separate confidentiality agreements or contractual provisions. Nothing in these public Terms overrides a specific written confidentiality agreement.
14. Fees
Certain Atlas services may require payment. Pricing, billing, payment obligations, taxes, renewal terms, and other commercial conditions will be established through applicable order forms, proposals, statements of work, or other written agreements.
15. Suspension and Termination
Atlas may suspend or terminate access where reasonably necessary because of:
- Violation of these Terms
- Security concerns
- Unauthorized access
- Illegal activity
- Non-payment where applicable
- Protection of Atlas or other users
- Legal or regulatory requirements
Termination does not automatically eliminate obligations that are intended to survive termination.
16. Disclaimers
To the extent permitted by applicable law, Atlas services are provided subject to their documented capabilities and limitations. Atlas does not guarantee that:
- Every output will be accurate
- Every prediction will occur
- Every recommendation will produce a desired outcome
- Services will always be available
- Services will satisfy every particular purpose
17. Limitation of Liability
To the maximum extent permitted by applicable law, Atlas will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from use of the services, except where such limitation is prohibited by law. Specific liability arrangements may be established through separate customer agreements.
18. Indemnification
Where permitted by applicable law, users or customers may be responsible for claims arising from their unlawful use of Atlas services, violation of these Terms, or infringement of third-party rights. Specific indemnification obligations may be established through separate agreements.
19. Privacy
Use of Atlas services is also subject to the Atlas Privacy Statement. Where Atlas processes personal information on behalf of an organization, additional contractual data protection terms may apply.
20. Electronic Communications
By communicating electronically with Atlas, you consent to receiving electronic communications where permitted by applicable law. Electronic records and communications may be used to establish contractual and business relationships where legally valid.
21. Changes to Services
Atlas may modify, improve, replace, or discontinue features and services. Where changes materially affect a customer under a separate agreement, the applicable agreement will govern the relevant notice or transition requirements.
22. Changes to These Terms
Atlas may update these Terms from time to time. The updated Terms will be published on the Atlas website with an updated effective date. Continued use of the applicable services after an effective update may constitute acceptance where legally permitted.
23. Governing Law
Unless a separate written agreement provides otherwise, these Terms are governed by the laws of Malawi.
24. Disputes
The parties should first attempt to resolve disputes through good-faith discussions. Where a dispute cannot be resolved informally, the applicable dispute-resolution provisions of a written customer agreement will apply. For matters governed solely by these Terms, applicable courts and dispute-resolution mechanisms under Malawian law will apply.
25. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
26. Entire Agreement
These Terms, together with any applicable additional terms or written agreements, constitute the applicable agreement concerning use of the relevant Atlas service.
